摘 要
随着不孕不育患病率攀升，越多越多人尝试通过人工辅助生殖技术孕育生命，这项技术满足了不孕不育夫妇做父母愿望的同时，带来了不少法律问题。本案从国内冷冻胚胎第一案入手提出法律问题，结合国内外理论和实践，对冷冻胚胎的法律属性进行分析，进而提出其权利归属和保护规则。本文将分五部分进行论述，第一部分从国内冷冻胚胎第一案入手，提出法律问题；第二部分讨论冷冻胚胎的物权属性问题；第三部分研究冷冻胚胎权利归属的问题；第四部分研究冷冻胚胎合同效力问题；第五部分是冷冻胚胎的保护规定问题。

Abstract
With the rising prevalence of infertility, the more people try to nurture life through artificial assisted reproductive technology that meets the infertile couples do parents desire the same time, brought a lot of legal issues.
